there was an article in deccan herald newspaper bangalore dated 27 may 2014.
"In keeping with a 1996 Supreme Court judgement, the State government will now include private lands as deemed forests if they meet the criteria it has laid down.The Forest department, in a meeting on May 24, had stated that those lands, which had 50 naturally grown trees per hectare, over and above the height of 30 cm, will be considered as deemed forest. If the land has 100 trees planted per hectare, above the height of 30 cm, it will again be considered as deemed forest."

1. is this applicable to all parts of karnataka or is it only near the western ghats?
2. what if we already have 1200 trees in 5 acres ?
3. do we have to take permission before felling?

Yes, you have to approach the agriculture officer/ talati to understand the procedure

there is absolutely no problem. Just ask the Tahsildar or the local agriculture officer for the procedure.

If you have the land documents,Patta,Chita and up to date tax payment to the revenue dept.concerned you have right to cut the trees with the proper cutting order from the concerned Dist.Forest officer.Now the govt.of India encouraging and permitting to cultivate all kinds value added trees in their own Patta lands.The new cultivators of the tree plantation initially making the necessary entries in the Village administration with payment of land tax.And get extract of the Patta/Chitta copies accompanying the covering letter indicating the prior intimation of the details of the which kind trees planted in your land .The total intimation letter addressed to the relevant District.forest officer.This will helps you in so many ways like proper guidance to grow the tree from time time ,periodical visit by the forest officials/authorities and easy process for issuing the cutting order.
