I have 10 acres of land in Punjab. This heredictory land registered on my name some 4 years back by my father.

My father had mortgaged the land some 11 years back. 4 years back he took back mortgaged papers and returned money. However the person continued tilling the land under informal arrangement and deposits rent in my fathers account. In other words this person is tilling our land for 11 years now.

The 'jamabandi' paper from 'patwari' shows me to be owner and land self cultivated. i work in Mumbai and visit village once a year. My father after retirement is settled in Chandigarh.

My question: Can the person tilling my land become owner or claim ownership if he continues tilling. What is advice of this forum members.

Thanks in anticipation.

Dear,

Views written below are mine. To make sure, you need a good lawyer.

Who is paying land tax? Is land tax paid in your name or in tillers name?

Indian law favours tiller than owner. It is advisable to get back the land and give to someone else from time to time.
